Terms and Conditions

Meal & Fitness Guides

Please allow 24-48 hours from the time you submit your order to receive your guide(s), responses to all questions, and request. Guides included in supplement packages and training programs will be sent via email to the email address you provide during checkout. If you do not receive your guide or a response within 24-48 check your junk/spam mail. If you don't see a response there, please CLICK HERE and submit a message, or email: info@coachshawnfitness.com


All guides are to be used independently. By purchasing program guides you agree to not hold the seller liable for illness or injury.


Distant Coaching

You have 30 days from the time your order was placed to activate distant coaching. If you do not activate distant coaching within 30 days of purchase your order will expire. No refunds will be issued for active and expired orders. All sales are final.


Personal Training, Virtual Training & Distant Coaching 

By engaging in Coach Shawn's Personal Training Program, you acknowledge and agree that it is your responsibility to consult with a physician or a health care professional before you begin. Furthermore, you agree to discuss any physical, nutritional and supplement changes or concerns you may have regarding your health with a physician and or dietician before starting this program.


Coach Shawn 80/20 Fit nutrition and fitness programs are designed for educational purposes only, not to substitute or replace professional medical treatment, rehabilitation, advice, or diagnosis. The guides and supplements included in the training programs are to be used independently. By purchasing the program, you agree not to hold the seller liable for illness or injury.


Personal Training

All sessions must be fully paid for at the time of booking; partial payments are not accepted. For 'Bundle Sessions,' clients must schedule at least one session per week, totaling an average of 8-10 sessions per month, except for 'Single Sessions'.


Late Fees

Bundle Sessions

Payment for all Bundle Session invoices is due on the 1st day of each month. Please be advised that a monthly late fee of $25 will be added to the invoice if the full payment is not made by the 3rd day of the month, and an additional $25 will be applied if the invoice is not paid in full by the 14th.


Single Sessions

Payment in full for all Single Session invoices must be received by the day prior to the first session date listed on each invoice. Failure to do so will result in a $25 late fee being applied to the invoice. To secure your preferred session date and avoid potential re-scheduling, I advise prompt payment of your invoice to prevent it from being booked by another client. Please note that sessions will only be confirmed once payment is received.


Interest-Free Pay Later Option!

To avoid any late fees, you can take advantage of an interest-free pay later option offered by PayPal on all invoices! This means that you can split your total into four payments, without any interest charges or late fees! It's an incredible opportunity to manage your payments more conveniently!


Partner Bundle Sessions

For 'Partner Bundle Sessions,' both participants must pay the full invoice to secure the booking and receive the discounted rate. If only one party pays and the other does not, the paying client will be moved to 'Bundle Sessions' and must cover the remaining balance in full before training. For instance, if a client paid $89.97 per session for 'Partner Bundle Sessions' and their partner fails to pay, the client will owe an additional $10 per session. No refunds will be provided for the balance. Alternatively, clients who have not started their training sessions can use the paid funds as a credit to purchase merchandise from Coach Shawn's store.


Rescheduling Sessions

Rescheduled training dates must be within the same month and cannot roll over into the following month. 'No show' notifications made within 24 hours of the session will not be rescheduled and are non-refundable. All rescheduling requests are considered requests only and are not guaranteed. Traffic delays are not considered valid reasons for rescheduling.


Sessions will be canceled if clients are late 15 minutes or more. Every minute clients are late (prior to the 15-minute deadline) will be deducted from scheduled training time.


Elite Body Transformation Program, Partner or Group Bundle Sessions:

Unlike 'Bundle Sessions,' 'Partner Bundle Sessions', 'Group Bundle Sessions' and 'SGPT Sessions' cannot be made up if the session is missed. If a client is not able to attend a scheduled session, they will not be able to reschedule the session in the future. Reschedule requests are strictly for '1-on-1 Bundle Sessions' only.


Sessions will be canceled if clients are late by 15 minutes or more. Every minute clients are late, up to the 15-minute deadline, will be deducted from the scheduled training time. Proper workout attire is required for each session; otherwise, Coach Shawn has the right to refuse training without a refund. Training sessions will last approximately an hour.


If Coach Shawn is unavailable and cancels a training session, he will contact the client to reschedule the session or allow the client to use the session as credit toward merchandise from his store.


Rescheduling Procedure (excluding Elite BTP)

Clients are required to submit all reschedule requests via text message, even if they have made the request verbally. The request will ONLY be considered valid if it is sent in the form of a text and responded to as received to avoid any misunderstandings or confusion. If you don't hear back within 24 hours, please send a follow-up message in case the text wasn't received.


Life Coaching

Rescheduling Call Sessions: 

 Call sessions are non-refundable and cannot be canceled. If the client does not answer the phone at the scheduled appointment time, the call session will not be rescheduled. However, if Coach Shawn is available, clients may request to reschedule training sessions only if they notify him at least 24 hours in advance. Notifications of a "no show" within 24 hours of the scheduled call will not be rescheduled.

Hygiene Policy

Maintaining a high standard of hygiene is essential for the comfort and well-being of all clients. I expect all clients to arrive at their sessions fresh and clean. If a client fails to meet these hygiene standards, they may be asked to leave and will not be able to reschedule their session.


Morning clients are expected to wash up or shower before coming to your session, even if you showered the night before. We tend to sweat during sleep and may not feel as fresh in the morning as we did when we went to bed.


Afternoon and evening clients not working from home are encouraged to keep a bag with hygiene products in their car to freshen up before coming, or in the restroom upon arrival if necessary. 


Payments

Checks not excepted. Cash, credit and debit only.


Refunds & Exchanges

All sells are final. Refunds and exchanges are not excepted for any products, or service.

1. Introduction

These Terms and Conditions govern your use of services, programs, products, events, and digital or physical deliverables provided by Coach Shawn Fitness (“Company,” “we,” “us”). Services may be delivered in person at our private studio in Atlanta, Georgia, and online through live video or digital programs. 2. Payment Policy

2.1 All payments are final. Payments are non-refundable and non-cancellable.
2.2 Payments secure limited-capacity services and reflect the immediate allocation of time and resources.
2.3 Your payment confirms your agreement to these Terms. Review your schedule before purchase.
2.4 If a payment plan or subscription is offered at checkout, its specific terms will apply in addition to this policy.

3. Fraudulent Chargebacks

3.1 Disputing a valid charge without legitimate grounds is considered fraudulent.
3.2 We may take immediate legal action under Georgia law.
3.3 We may seek the full amount, bank and platform fees, attorney’s fees, and damages.
3.4 We may report fraud to payment platforms and institutions.
3.5 Services will be terminated and all remaining deliverables forfeited.

4. Scheduling Policy

4.1 Booking windows. Unless stated otherwise in your checkout or confirmation email:

  • Your initial intake or assessment must be scheduled within 5 calendar days.

  • Core services must be scheduled within 10 calendar days.

  • All purchased services expire if not scheduled within 90 calendar days.
    4.2 Scheduling support. Our team will reach out by email, text, phone, or direct message. You are responsible for scheduling within the timeframes.

5. Rescheduling, Cancellations, and No-Shows

5.1 Rescheduling. Submit requests in writing. Not all programs allow rescheduling—please review your program’s specific rescheduling policy. If we cannot accommodate your request within the service window, services and payment may be forfeited.
5.2 Late arrivals. Sessions end at the scheduled time. Late arrivals shorten your session.
5.3 No-shows or missed deadlines. Missed sessions or failure to complete required forms or check-ins may result in loss of service with no refund.
5.4 Why this policy exists. We operate a small, high-touch calendar. Delays block access for other clients.

6. Delivery of Services

6.1 Timelines. We deliver services by the agreed Project End Date or package period.
6.2 Possible deliverables.

  • Personal training, one-on-one or small group, in person or online

  • Distant or online coaching and accountability

  • Nutrition education and general meal guidance

  • Fitness plans, habit coaching, progress tracking, and check-ins

  • Workshops, events, and challenges

  • Post-session guidance and recap emails

  • Access to our mobile app or digital platforms if included in your package

7. Client Responsibilities

7.1 Complete all required intake forms honestly, including health history and goals.
7.2 Obtain medical clearance if needed.
7.3 Follow safety instructions. Use proper form. Stop if you feel pain, dizziness, or shortness of breath.
7.4 Keep your contact information current.
7.5 Respect studio rules and other clients.

8. Health and Assumption of Risk

8.1 Health disclaimer. We are not medical providers or registered dietitians. Fitness coaching and nutrition guidance are educational and general. They are not medical diagnosis, treatment, or medical nutrition therapy.
8.2 Assumption of risk. You understand fitness activities involve inherent risks. You voluntarily assume all risks of injury, illness, or death arising from participation, including from equipment use, environment, and your own conduct.
8.3 Release. To the fullest extent allowed by law, you release and hold harmless Coach Shawn Fitness, its owner, employees, and contractors from claims arising from your participation, except where prohibited by law.
8.4 Emergency care. If needed, you consent to emergency medical care. You are responsible for related costs.

9. Nutrition and Results Disclaimers

9.1 No guarantees. Results vary based on effort, adherence, sleep, stress, lifestyle, and health factors. We cannot and do not guarantee specific outcomes, weight change, or body composition results.
9.2 General guidance only. Any nutrition or meal guidance is educational. Work with your licensed healthcare provider for medical conditions, allergies, or specialized diets.

10. Exclusivity and Transfers

10.1 Services are for the purchasing client only. They are not transferable or shareable unless we approve in writing.

11. Limit of Liability and Indemnification

11.1 Our maximum liability is limited to the amount you paid for the specific service in question.
11.2 You agree to indemnify and hold harmless Coach Shawn Fitness, its owner, employees, contractors, and affiliates from claims arising from your participation, actions, or inaction.

12. Media, Testimonials, and Privacy

12.1 Optional media. We may request before and after photos, videos, or testimonials. Participation is optional.
12.2 Consent. If you opt in, you grant us a worldwide, royalty-free license to use approved media or testimonials for marketing on our website, Instagram, and other platforms. You can withdraw future use by emailing us. Past published items may remain archived. Coach Shawn 80/20 FitInstagram
12.3 App and digital platforms. If your plan includes access to our mobile app or digital tools, your use must follow the app’s terms and privacy policy. Google Play

13. Intellectual Property

13.1 All plans, programs, videos, templates, guides, and materials we create are our intellectual property.
13.2 You receive a personal, non-transferable license to use purchased materials for your own training only.
13.3 You may not copy, resell, share, distribute, or publish our materials without written permission.
13.4 We will enforce our rights, including injunctive relief and damages.

14. Non-Disparagement

14.1 You agree not to make false statements about the Company, its owner, team, or services.
14.2 If you have a concern, contact us directly so we can address it.
14.3 Breach may result in termination of services, removal of access, and legal remedies.

15. Studio Conduct and Safety

15.1 Follow posted rules, trainer instructions, and hygiene standards.
15.2 Wear appropriate footwear and attire.
15.3 Do not enter restricted areas or use equipment without instruction.
15.4 We may refuse service to anyone who poses a safety risk or disrupts others.

16. Minors

16.1 Clients under 18 require a parent or legal guardian to sign all documents and be present as required.

17. Changes, Suspension, and Termination

17.1 We may modify offerings, schedules, or policies to maintain safety and service quality.
17.2 We may suspend or terminate access for violation of these Terms or unsafe conduct.
17.3 Material changes to these Terms will be posted on this page with an updated date.

18. General Terms

18.1 Governing law. Georgia law applies, without regard to conflict of law rules. Venue and jurisdiction are in the state or federal courts located in Georgia.
18.2 Severability. If any part of these Terms is invalid, the rest remains in effect.
18.3 Entire agreement. These Terms are the entire agreement and supersede prior discussions or emails.
